He can refuse to play and they can still refuse to post him. The Baystars get more money if Maki goes to the open market as a free agent as opposed to an amateaur deal.
You used to be able to retire and sign with a MLB team, but that's been patched up.
How do they get more money?
Because MLB teams are capped to how much money is spent in the international pool. Teams only have X amount of to spend, they can't go over.
So the under $10m the Dodgers spent on Sasaki isn't a lot of money for the Marines (roughly $1.5m). In comparison, the Buffaloes got a lot of money when Yamamoto signed $325m (roughly $51m) as an unrestricted free agent.
Technically you can exit early via retirement anytime but that voids your contract and both NPB and MLB teams don’t like it
Doesn’t the NPB Franchise have to willingly sign the retirement papers? That’s how Nomo was able to come to MLB. He and his agent purposefully made the contract negotiations contentious and then he threatened to retire. They signed them without realizing the loophole. Considering that’s been widely reported and known for decades now, I’d assume in a similar circumstance the NPB franchise could refuse to acknowledge the retirement.
In theory you can renege on your contract and it’s cancelled by default just like any other job, but then you won’t be signed by MLB for obvious reasons. Nomo was using the official retirement system as it existed then rather than just walking out.
Maybe Maki can just use it as leverage.
Has anyone just cut a deal to buy out their own contract in the past?
No, European football-style buyout/release clauses do not exist in Japanese baseball. Threating to retire would give Maki zero leverage because the BayStars would continue to hold his rights unless he is granted posting or he becomes eligible for International Free Agency after 9 years of service time.
Furthermore, the fallout of the Nomo - and by extension, the Irabu and Alfonso Soriano sagas - is why the posting system exists in the first place.
He could do what Nomo did and just retire. Then sign with a team. It’s considered really bad though like socially.
That loophole was closed a long time ago
Citing what Nomo did when he was the very reason they closed the loophole (and ushered in the posting system). Doing it in the modern day would be akin to a team not honoring the contract of another team, which isn't really a precedent I see any of them being all that enthusiastic to set.
